INTELLIGENCE RISING – TERMS & CONDITIONS

(Online Courses and Digital Training)

1. Acceptance of Terms

By accessing, purchasing, or using any course, content, or services provided by Intelligence Rising (“we”, “us”, “our”), you agree to be bound by these Terms & Conditions.

If you do not agree, you must not access or use our courses.

You must be at least 18 years of age to purchase or access our services.

2. Nature of Services

Intelligence Rising provides professional training and educational content in intelligence analysis, decision-making, and related disciplines.

All courses are delivered via an online platform and may include:

• Video content
• Written materials
• Exercises and assessments
• Downloadable resources

Our courses are designed for professional development purposes only.

They do not constitute operational, legal, investigative, or strategic advice.

3. User Account

To access courses, you may be required to create an account.

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your login details
• Not share your account with any other person

You are responsible for all activity conducted under your account.

4. Licence and Permitted Use

Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable licence to access course content for your personal or authorised organisational use.

You must not:

• Share login credentials
• Copy, reproduce, distribute, or resell course content
• Record, screen capture, or redistribute materials
• Use content for commercial training or delivery without written permission

This licence is granted to a single user unless otherwise agreed in writing.

5. Organisational Use

Where courses are purchased on behalf of an organisation:

• Access is limited to the number of licensed users
• Accounts must not be shared across individuals
• Redistribution of content within or outside the organisation is prohibited

Additional licences must be purchased for additional users.

6. Payment Terms

All prices are listed in Australian Dollars (AUD) unless otherwise stated.

Payment must be made in full at the time of purchase.

We may use third-party payment providers. You agree to their terms as part of the transaction.

Failure of payment may result in:

• Suspension of access
• Termination of your account

7. Refunds and Transfers

We understand that circumstances may change. The following refund and transfer terms apply:

Change of Mind Refunds
 Refunds are available for change of mind only where the course has not been accessed or commenced in any way.

A course will be considered “commenced” if you have:

• Viewed any course content; or
• Downloaded any materials

Once a course has been commenced, no refunds will be provided.

Transfer of Enrolment
 Where a course has not been commenced, you may request to transfer your enrolment to another individual.

All transfer requests must:

• Be made in writing; and
• Be approved by Intelligence Rising

We reserve the right to refuse transfer requests where misuse or abuse of this provision is suspected.

Fees and Deductions
 Where a refund is approved, the refunded amount will be less any non-recoverable payment processing fees incurred by Intelligence Rising at the time of purchase.

Australian Consumer Law
 Nothing in this clause limits your rights under Australian Consumer Law.

8. Intellectual Property

All content provided by Intelligence Rising, including but not limited to:

• Course materials
• Methodologies
• Frameworks
• Written, visual, and audio content

is owned by or licensed to Intelligence Rising and is protected by intellectual property laws.

You must not:

• Copy or distribute content
• Modify or create derivative works
• Use content for training others

Unauthorised use may result in:

• Immediate termination of access
• Legal action

9. User Conduct

You agree not to:

• Engage in unlawful, abusive, or disruptive behaviour
• Harass or intimidate other users
• Upload or share harmful or inappropriate content
• Use course material for unethical or illegal purposes

We reserve the right to remove content and suspend or terminate access where necessary.

10. Security and Sensitive Information

Given the nature of our subject matter, you agree that you will not:

• Disclose classified, confidential, or operationally sensitive information
• Share restricted or protected data within course activities

You are solely responsible for ensuring compliance with your organisational or legal obligations.

11. No Reliance / Disclaimer

All content is provided for educational purposes only.

We make no representations or warranties that:

• Course content is complete, accurate, or applicable to your circumstances
• Outcomes will be achieved from participation

You acknowledge that:

• Decisions made based on course content are your responsibility
• Intelligence Rising is not responsible for operational, professional, or organisational outcomes

12. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential loss
• Our total liability is limited to the amount paid for the relevant course

Nothing in these Terms excludes rights under Australian Consumer Law that cannot be excluded.

13. Access and Availability

We do not guarantee:

• Continuous or uninterrupted access
• That the platform will be error-free

We may:

• Modify, update, or remove content
• Restrict access where necessary

14. Termination

We may suspend or terminate your access at any time if:

• You breach these Terms
• Payment issues arise
• Misuse of content is detected

Upon termination:

• Your licence to access content ends immediately
• No refunds will be provided

15. Certification and Outcomes

Where certificates are issued:

• They confirm course completion only
• They do not constitute professional accreditation, licensing, or employment qualification with the exception of the Certificate of Intelligence Practice.
• To attain the accreditation for the Certificate of Intelligence Practice, all assessments must be completed to the satisfaction of the Convenor before the accreditation will be issued.

16. Privacy

We collect and manage personal information in accordance with our Privacy Policy.

By using our services, you consent to this collection and use.

17. Changes to Terms

We may update these Terms at any time.

Updated Terms will take effect upon publication.

Continued use of our services constitutes acceptance of any changes.

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes will be subject to the jurisdiction of the courts of New South Wales.

19. General Provisions

• If any provision is invalid, the remaining provisions remain in effect
• Failure to enforce any right does not constitute a waiver
• These Terms constitute the entire agreement between you and Intelligence Rising
